Terms of Service

These Terms of Service (“Terms”) govern your use of the Bespoke Movementwebsite, mobile application, studio classes, memberships, and video library (collectively, the “Services”). By accessing or using the Services you agree to be bound by these Terms. If you do not agree, do not use the Services.

Bespoke Movement is located in Bellingham, Washington. References to “we,” “us,” or “our” refer to Bespoke Movement.

1. Accounts

You must be at least 18 years old to create an account. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately at pilatespnw@gmail.com if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.

2. Classes & Bookings

Reservations

Classes must be booked in advance through the website or app. Booking a class reserves your spot; spots are limited and not guaranteed until confirmed.

Cancellations & Late cancellations

You may cancel a booking without penalty up to 12 hours before the scheduled class start time. Cancellations within 12 hours, or no-shows, may result in the forfeiture of one class credit from your pack or a late-cancel fee, at our discretion.

Waitlists

If a class is full you may join the waitlist. You will be notified by email if a spot becomes available. It is your responsibility to cancel your waitlist spot if you can no longer attend.

Studio conduct

You agree to arrive on time, follow instructor guidance, and treat staff and fellow participants with respect. We reserve the right to remove anyone from a class for unsafe or disruptive behavior without refund.

3. Memberships & Packages

Pricing

All prices are listed in US dollars. We reserve the right to change pricing with at least 30 days' notice to active members.

Recurring memberships

Monthly memberships auto-renew on your billing anniversary date. You may cancel at any time; cancellation takes effect at the end of the current billing period. No partial-month refunds are issued unless required by applicable law.

Class packs

Class packs are non-refundable and non-transferable unless otherwise stated at the time of purchase. Any stated expiry date is enforced; unused credits after expiry are forfeited.

Refunds

All sales are final unless a class is cancelled by us. If we cancel a class, you will receive a full credit to your account. For extraordinary circumstances, refund requests may be submitted to pilatespnw@gmail.com and will be reviewed on a case-by-case basis.

4. Video Library & Digital Content

Access

Certain videos are available free of charge. Others require a single purchase or an active subscription. Access is granted to you personally and is non-transferable.

Restrictions

You may not download, record, redistribute, or resell any video content. The videos are for your personal, non-commercial use only. Sharing login credentials to circumvent access restrictions is prohibited and may result in account termination.

Availability

We may add, remove, or modify video content at any time. Removing content from the library does not entitle you to a refund of any subscription or purchase price.

5. Payments & Billing

Payments are processed by Stripe. By making a purchase you authorize us to charge your payment method for the amounts shown. You agree to Stripe's Terms of Service. We do not store full card numbers; see our Privacy Policy for details.

If a payment fails we may suspend your access until the outstanding balance is resolved. Repeated failed payments may result in account termination.

6. Health & Safety Disclaimer

Physical activity carries inherent risk of injury. By participating in any class or using our video content you acknowledge that:

• You are physically capable of participating and have consulted a physician if you have any medical conditions, injuries, or concerns.
• You will inform your instructor of any injuries or limitations before class.
• You participate at your own risk and assume full responsibility for any injury, loss, or damage that may result.
• Bespoke Movement and its instructors are not liable for injury resulting from your participation, except where liability cannot be excluded by law.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

7. Intellectual Property

All content on the website and app — including text, images, video, logos, and software — is owned by or licensed to Bespoke Movement and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

8. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose.
• Attempt to gain unauthorized access to any part of the Services.
• Transmit any harmful, offensive, or disruptive content.
• Scrape, crawl, or data-mine the website or app without permission.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

9. Third-Party Links & Services

The Services may contain links to third-party websites or integrate third-party services (e.g., Stripe for payments). We are not responsible for the content, privacy practices, or terms of those third parties. Use them at your own risk.

10. Disclaimer of Warranties

The Services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of viruses.

11. Limitation of Liability

To the maximum extent permitted by law, Bespoke Movement shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or relating to these Terms or the Services shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Bespoke Movement, its instructors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Services, your violation of these Terms, or your violation of any third-party rights.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-law provisions. Any dispute arising from or relating to these Terms or the Services shall be resolved in the state or federal courts located in Whatcom County, Washington, and you consent to the personal jurisdiction of those courts.

14. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms with an updated “Last updated” date. For material changes we will notify active members by email at least 14 days before the change takes effect. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms.
